Overview

How we handle rights

skowt.cc hosts files from games, including 3D models and their animations, and files made by fans, and its game pages show header videos from the games' official launchers. Game content belongs to its publishers and fan-made work to its creators; skowt.cc doesn't claim to own any of it, and isn't affiliated with any publisher.

If your work is on skowt.cc and you don't want it there, tell us and we'll take it down. We aim to act on notices within 48 hours. We usually do, though sometimes it takes longer.

Publishers' fan content policies

Many publishers allow fan use of their games' content under their own fan content policies, and each file's Usage box links the one for its game. Those policies are the publisher's to set. If skowt.cc's use of your game's content goes beyond what you allow, a notice from you settles it: we'll remove what you ask, up to a whole game.

Takedown notices

How to send a notice

There are two ways, and you don't need an account for either:

  • On the file's page, open the More menu (the three dots), press Report and pick This is my work or my company's. Add the details below and an email so we can reply
  • Or email [email protected], especially for many files, a whole game, or a formal DMCA notice

What to include

So we can act quickly, a notice should have:

  • links to the files or pages you want removed. For a whole game or category, a link to it is enough
  • what the original work is, and that you own it or are allowed to act for whoever does
  • why it shouldn't be on skowt.cc
  • your name and an email address or other way to reach you
  • a statement that you believe in good faith the use isn't authorised by the rights holder, its agent or the law
  • a statement that the information in your notice is accurate, and, under penalty of perjury, that you're the rights holder or authorised to act for them
  • your physical or electronic signature (typing your full name works)

The last three are what the US Digital Millennium Copyright Act asks for. If you leave something out we may ask for it, but we'd rather act on a short notice than wait for a perfect one.

What happens next

A person reads every notice. When it's clear, we remove the files or block access to them, and reply to say what we did. If we need more from you, or decide not to act, we'll tell you why.

We tell the uploader which files came down, why, and how to send a counter-notice. We may pass your notice on to them, with your name and the work it's about, so they know who to talk to if they believe it was a mistake. Leave out anything you don't want shared, like a personal phone number.

Counter-notices

If your upload was removed

If you believe a file of yours was taken down by mistake, or you have the right to share it, email [email protected] with a counter-notice. It should include:

  • the file that was removed, and where it was on skowt.cc (its link)
  • a statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification
  • your name, address and phone number
  • a statement that you consent to the jurisdiction of the US federal district court for your address, or, if you're outside the US, any judicial district in which Antifield LTD may be found, and that you'll accept service of process from the person who sent the notice
  • your physical or electronic signature

We send the counter-notice to whoever sent the original notice. Unless they tell us within 10 to 14 business days that they've started court action, we'll put the file back.

Not sure about any of this? Ask us first. A counter-notice is a legal statement, and you should only send one if you're confident.

Policies

Repeat infringers

Uploaders who repeatedly post files they don't have the rights to lose their uploader role, and in serious or repeated cases their account.

False or abusive notices

Sending a notice or counter-notice you know is false can make you liable for damages. If someone keeps sending notices that are plainly unfounded, we may stop acting on their notices after warning them.
